We always go to the police station where we often have problems due to ignorance of the law. Police are shocking because they do not know the law, or refuse to register our complaint. Often the police refuse to register our complaint, saying that you are late by showing the law. And in many cases, police are sent to another police station your complaint, saying they do not seem to be off limits. Speaking at the time Gujarat is working for legal awareness, in today's article we will know how many complaints can be filed in the late hours.
What is an FIR?
FIR is called "First Information Report" Any person who goes to the police station to announce or inform the police of any incident or incident and the police register their book crime according to CRPC Article 1 on the basis of that information is called FIR. For example, if a murder occurs at any place, the person who goes to the police station and gives the first information about the murder to the police is called a complaint and on the basis of the complaint, the police register the crime in his book.Usually any crime complaint is to be registered at the police station in the area where the incident took place. Each police station has a complaint register in which the number of crimes registered from January to December is given 1,3,4,5,3. In every police station in India, the number is given in this way.
Cognizable Offenses (Police Rights Offenses):
Crimes of police rights are those crimes wherein the police have the power to arrest the accused and investigate the crime. The police do not need a magistrate's warrant or order to investigate the cognizable crime and arrest the accused. According to CRPC Article 154 on the basis of the first information of the police in cognizable crime, FIR can be investigated, arrested and the accused arrested. Cognizable offenses are crimes of serious nature, including murder, robbery, theft, rape, racketeering, intimidation, uprising, injury, kidnapping, attempted murder, unlawful association, obstructing the work of a civil servant, etc. In short, cognizable crimes are those in which police can arrest without a court warrant.Non-cognizable (crimes outside police rights):
Police cannot register or investigate crime without arrest of Magistrate without the permission of Magistrate in offenses outside the police force. In the case of non-cognizable crime, police officers are ordered by the Judicial Magistrate to take special action. Non-cognizable offenses are common types of crimes which include espionage, public nuisance, religious offenses, bribery, misinformation, defamation, fraud, fraud, etc. The non-cognizable type of crime does not require the police to file a complaint, but the register / applicant is advised to contact the concerned magistrate by registering with his own registrar. Short non-cognizable offense is a crime in which the police cannot arrest without the magistrate's permission. What is the zero number complaint?
As per CRPC Article VII: If any cognizable offense is made then you can go to the police station and give the first information immediately and submit an FIR. But to file this complaint, you have to go to the police station in your area or the area police station where the crime has been committed so that a proper complaint can be made. In most cases, the police dismiss the complaint by saying that their area does not apply."Justice Verma Committee" was formed to amend the law after Dillima Nirbhaya rape incident took place in year 1 and according to the recommendation of this committee, in year 1, the "Criminal Procedure Act." - The provision of Zero Number Complaint was made easier and tougher by passing it in Parliament. Zero numbers can be filed at any police station.
As mentioned above, every police station has a complaint number of 1,3,3, but when there is a serious incident, the complainant is given a serial number by registering the immediate complaint without interruption. Does not come but a complaint is registered with zero number. The crime is then transferred to the police station area where the complaint is transferred. In another applicable police station, this complaint is numbered according to the series and the entire matter is investigated at another police station.
Zero (0) Number Complaint -Why?
Good for gathering evidence, preventing destruction of evidence, arresting accused or investigating immediately in the event of a serious incident. For example, if a woman is abducted from Ahmedabad and taken to Rajkot, then it takes a long time to report the rape in Ahmedabad. Therefore, if both abduction and rape are registered in Rajkot, medical treatment of the victim can be collected from the premises. Thus, the Rajkot police registered the zero number and transferred it to the Ahmedabad police. In which case can Zero be prosecuted?
Rape, murder, robbery, exploitation, dowry, torture of a woman etc; can be sued with zero number in many cases. While registering a zero complaint, the police station's location or location of the crime is not taken into account. The purpose of the Zero Complaint is to register the victim with the highest intention of speeding up justice, investigating, gathering evidence, arresting the accused. In case of any crime in our vicinity, we should go to the police station and file a complaint. If the police do not file a complaint, we should file a complaint and file a complaint on the basis of application. If not, you need to go to court. Gujarat's appeal is to learn the law and become a citizen aware of the use of the law.
